Privacy Statement

Version: V3.7 – October 2012

Applied Recognition is committed to protecting your privacy, while providing you with leading edge software utilities. This privacy statement explains the data collection and use practices of Fotobounce. This statement focuses on features in Fotobounce that communicate with the Internet and does not apply to data collected through other online or offline Applied Recognition sites, products, or services.

Collection and Use of Your Personal Information

When we need information that personally identifies you or allows us to contact you, we will explicitly ask you for it. The personal information we collect from you will be used by Applied Recognition and affiliates to provide the service(s) or carry out the transaction(s) you have requested or authorized. In support of these uses, Applied Recognition may use personal information to provide you with more effective customer service, to improve Fotobounce and any related products or services, and to make Fotobounce easier to use by eliminating the need for you to repeatedly enter the same information or by customizing the service to your particular preference or interests.

Except as described in this statement, personal information you provide will not be transferred to third parties without your consent. We occasionally hire other companies to provide limited services on our behalf, such as providing customer support, processing transactions, or performing statistical analysis of reports. Applied Recognition will provide these companies only the information they need to deliver the service. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose.

Information that is collected by or sent to Applied Recognition may be stored and processed in Canada, the United States, or any other country in which Applied Recognition or its affiliates, subsidiaries or agents maintain facilities, and by using an Applied Recognition product, you consent to any such transfer of information outside of your country. Applied Recognition abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of data from the European Union. Applied Recognition may disclose personal information about you if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Applied Recognition; or (b) protect and defend the rights of Applied Recognition (including enforcement of our agreements).

Collection and Use of Information about Your Computer and Photos

Fotobounce contains Internet-enabled features that collect certain standard information from your computer (“standard computer information”) and send it to Applied Recognition. Standard computer information typically includes information such as your IP address, operating system version, Fotobounce version and your regional and language settings. If Fotobounce sends information to Applied Recognition, standard computer information may be sent as well. Fotobounce also collects various usage-related information such as the number of photos you are managing with the product. This usage information is used to improve the product and is not shared with third parties.

The privacy details for each Fotobounce feature, software or service listed here will disclose what additional information is collected and how it is used.

Face Recognition Data

One of the key features of the Fotobounce desktop product is the use of advanced face recognition algorithms to speed up the tagging of your photos. This data remains on your computer at all times and is at no time stored on our company servers. We adhere to the recent FTC guidelines for protection of consumer data related to face recognition that were published in October 2012.

Printing Services

When you request printing services for a Fotobounce album(s), our printing affiliates will have to collect contact, shipping and billing information to enable delivery of your print material. Your photos to be printed will also be sent electronically to our printing affiliates via their website. Each of these printing affiliates has their own privacy policy.

Advertising in Fotobounce

When you use Fotobounce you will see advertisements that are periodically updated.

Advertisements in Fotobounce typically come from third-party ad servers or ad networks. Applied Recognition sources display advertisements from these companies to deliver to the Fotobounce software.

Some of these ad networks may place a persistent cookie on your computer in order to recognize your computer each time they send you an advertisement. A cookie is a small text file that is placed on your hard disk by an online server. Cookies contain information that can later be read by an online server in the domain that issued the cookie to you. Cookies cannot be used to run programs or deliver viruses to your computer. You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. Note that Applied Recognition does not use cookies, and Applied Recognition does not have access to the cookies that may be placed by the third-party ad servers or ad networks.

Advertisements displayed in Fotobounce may contain electronic images known as Web beacons – sometimes called single-pixel gifs – in order to help compile aggregated statistics and determine the effectiveness of promotional campaigns. We prohibit Web beacons in advertisements displayed in Fotobounce from being used by third parties to collect or access your personal information.

Finally, we may work with other companies that advertise in Fotobounce to place Web beacons on their sites in order to allow us to develop statistics on how often clicking on an advertisement in Fotobounce results in a purchase or other action on the advertiser’s site.

In these ways, Applied Recognition and ad networks may compile information about what advertisements are seen in Fotobounce and determine which ads are clicked on. In addition, advertisements may be stored on your machine for display while you are offline. Applied Recognition may compile information about what advertisements are seen in Fotobounce and determine which ads are clicked on and may share that information with ad networks. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you.

Applied Recognition may use demographic information collected from you during the registration process (including age, location and gender data) to target advertisements that we believe will be of most interest to you.

Security of your information

Applied Recognition is committed to protecting the security of your information. We use a variety of security technologies and procedures to help protect your information from unauthorized access, use, or disclosure. For example, we store the information you provide on computer systems with limited access, which are located in controlled facilities.

Changes to this privacy statement

We will occasionally update this privacy statement to reflect changes in our products and services and based on customer feedback. When we post changes to this Statement, we will revise the “last updated” date at the bottom of this statement. If there are material changes to this statement or in how Applied Recognition will use your personal information, we will notify you either by prominently posting a notice of such changes prior to implementing the change or by directly sending you a notification. We encourage you to periodically review this statement to be informed of how Applied Recognition is protecting your information.
